301. maddeyle ilgili değişiklik teklifini ceza hukuku uzmanlarına sorduk. Farklı bakış açılarıyla, hepsi teklifte ‘tehlikeli’ açıklar buldu.
İSTANBUL - AK Parti’nin 301. madde için sunduğu değişiklik teklifi, iznin cumhurbaşkanına bırakılmasını destekleyenlerle, desteklemeyenler olarak hukukçuları ikiye böldü. Ceza hukukçuları NTVMSNBC’ye teklifi değerlendirirken, Prof. Bahri Öztürk, teklif metninde vahim bir yanlışlık olduğu uyarısı yaptı. Teklifte ‘kovuşturma’ izni cumhurbaşkanına bırakılıyor. Öztürk’e göre bu, şu anlama geliyor: Savcılık suç şüphesini öğrendikten sonra soruşturmayı yapacak, gözaltı ve tutuklama kararları verilecek, iddianameyi hazırlayacak, ama mahkeme yargılama yapabilmek için Cumhurbaşkanlığı makamından izin isteyecek.
